Deutsche Leasing ČR, spol. s.r.o., Id. No.: 257 23 758, with its registered seat at Antala Staška 2027/79, Krč, 140 00 Praha 4, registered in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 66451 (hereinafter referred to as " Deutsche Leasing ") continues to simplify the use of its services and reduces the environmental footprint associated with its operations and therefore it increasingly digitizes its interactions with clients, including the execution of contractual documentation. Thus, Deutsche Leasing now accepts electronic signing of contracts and aims to send related documentation electronically (see below).
Electronic signing
Certain types of bilateral legal documents can now be signed by using the DocuSign system. The minimum system requirements for using DocuSign may change over time. The current system requirements can be found here:

Under Czech law contracts can be signed electronically, whereas everyone has the right to choose the form of legal acts, unless they are restricted in their choice of form by a contract or a law. The relevant contractual documentation will be now sent to you via the DocuSign system in pdf format, which you will then sign electronically. In order to maintain legal certainty about your legal act, the system is set up to allow document signing only with an electronic signature that meets at least the criteria set for an advanced electronic signature based on a qualified certificate for electronic signature (this is a signature which includes the time of the signature, the data on signatory´s identity are attached via a qualified certificate and which is linked to the signed data in such a way that any subsequent change in the data is detectable) by Regulation (EU) No 910/2014 of the European Parliament and of the Council on electronic identification and trust services for electronic transactions in the internal market (eIDAS) and Act No. 297/2016 Coll, Act on Trust Services for Electronic Transactions, as amended.
In order to be able to conclude contractual documentation electronically with Deutsche Leasing via the DocuSign system, you need to have at least a publicly recognized electronic signature (in Czech: “uznávaný elektronický podpis”, issued by a certification authority - e.g. PostSignum or also DocuSign at advanced signature levels), which must always be valid on the date of execution. Forms of electronic signature below these requirements are not accepted by Deutsche Leasing for the execution of contracts and therefore may not be used.
If you and Deutsche Leasing attach your recognized or qualified electronic signature to the electronic contract document, the relevant contract is legally concluded and you can download the electronic original directly from DocuSign. However, the written original of the concluded contract in paper form can only be obtained by conversion of the electronic original in accordance with Act No. 300/2008 Coll., Act on Electronic Acts and Authorized Conversion of Documents, as amended.
Deutsche Leasing has no legal obligation to provide you with the original of the concluded contract in paper form. If you wish to obtain an original in paper form, you need to arrange for it yourself at your own expense. The conversion of an electronic original to paper form is one of the services provided under law by e.g. Czech POINT or some attorneys-at-law.
Sending documents in electronic form
If you have consented to e-communication with Deutsche Leasing documentation relating to your business case, in particular various notices disclosures and acknowledgements from Deutsche Leasing, will be delivered to you via the e-mail address you provided to Deutsche Leasing.
E-communication means in particular sending an e-mail marked with Deutsche Leasing´s electronic mark based on a qualified system certificate within the meaning of Act No. 297/2016 Coll., the Act on Trust Services for Electronic Transactions, as amended. This e-mail then contains a document in Portable Document Format (PDF) containing the message, or it refers to the exchange of documents between the parties via the DocuSign system.
If you have given us a consent to e-communication, you are entitled to withdraw this consent at any time by sending such information in writing to
info@dlcr.cz. The withdrawal of such consent shall take effect 1 month after receipt thereof.
